Decisions on polling day activities in Kosovo

PRISTINA, 1 December 2000 - The Central Election Commission (CEC) made final decisions on three cases referred to it by the Election Complaints and Appeals sub-Commission (ECAC). These cases involved activities in violation of Electoral Rule 2000/13 on Election Day by Polling Station Committee members and a President of a Municipal Election Commission (MEC).
In case PD 2000/072, the MEC President in Vushtrri/Vucitrn intervened in the voting process by looking behind the voting screen at a voters ballots and providing instructions to the voter based on his observations. The CEC agreed with the recommendation of the ECAC to remove Mr. Xhafer Maliqi from his position.
The other two complaints, PD 2000/061-062 and PD 2000/127, dealt with Polling Station Committees. In the first case, the Chairperson in a Polling Station in Skenderaj/Srbica was accused of improperly assisting voters, allowing more than one voter behind a voting screens and influencing people to vote for a specific political entity. The second case involved a polling station committee member in Shtime/ timlje who was also a candidate for the Republican Party of Kosovo (PRK), a violation of Electoral Rule 2000/9. The CEC directed that these individuals would be barred from future work on polling station committees.
The CEC also decided to refund the certification fee to those political entities that had competed in the election. Each political party, coalition, citizens initiative, or independent candidate was required to submit 100 DM for each municipality in which they wished to contest the election. Electoral Rule No. 2000/3 provides for this fee to be refunded where entities won a mandate or if the certification application was rejected. The CEC determined that the certification fees would be returned for the municipalities that were not recommended for certification. The OSCE began disbursing these funds this week.
