Kosovo Media Appeals Board finalizes rules of procedure

PRISTINA, 1 September 2000 - The Media Appeals Board in Kosovo held its first meetings on 30-31 August 2000. As required by UNMIK Regulation 2000/36, Section 4.6, the Board finalized rules of procedure to govern the filing of appeals and the conduct of hearings. These are being translated and will be issued simultaneously in English and Albanian.
Regulation 2000/36 calls on the Board to ensure that its procedure guarantees fair and impartial proceedings in accordance with internationally recognized human rights standards.
Members of the Media Appeals Board are required to act independently and impartially in the determination of appeals lodged against decisions of the Temporary Media Commissioner, for example, to refuse broadcasting licences or to impose sanctions on the print media.
First Hearings
The first appeal will be heard by the Media Appeals Board in the week of 11 September 2000. The Board is competent to uphold, modify or rescind decisions of the Temporary Media Commissioner. It will give its decisions on the basis of written submissions and after oral hearings.
Background
On 29 August 2000, the Special Representative of the Secretary-General, M. Bernard Kouchner, set up the Media Appeals Board provided for by UNMIK Regulation No. 2000/36 of 17 June 2000.
Acting on the recommendation of the Deputy Special Representative of the Secretary General for Institution Building, Ambassador Daan Everts, the Special Representative has appointed two international members and one national (Kosovar) member of the Media Appeals Board. Mr. Guy S. Goodwin-Gill, Ms. Julie Chadbourne and Mr. Ramadan Vraniqi will sit as Members of the Board until further notice.
Mr. Goodwin-Gill, who holds joint British and Canadian citizenship, is a Professor at the University of Oxford and Member of the English Bar. He teaches international law, international human rights and the law of war, and has published on issues including international refugee law, free and fair elections, and international criminal law. He will act as President of the Media Appeals Board.
Ms. Chadbourne is an American citizen and a Member of the New York Bar. She is a human rights lawyer with wide experience in the human rights activities of non-governmental organizations in the region, and most recently co-ordinated the collection and processing of refugee interview data in a war crimes documentation project established to support the activities of the Hague tribunal. She has also published on legal trends in Pakistan with regard to the Zina Ordinance, and on South African youth perspectives on juvenile justice.
Mr. Vraniqi is appointed as a local (Kosovar) member of the Media Appeals Board. He qualified as a lawyer in the Universities of Beograd and Belgrade, and has served as a Judge and the President of the Municipal Court in Pristina, a Judge and the President of the Supreme Court of Kosova, and a Judge for the Constitutional Court of Yugoslavia. For many years he was a Professor in the University of Pristina, Faculty of Law, and as President of the Lawyer's Association of Kosova.
