Manual on the use of Deferred Prosecution Agreements
The manual deals with the proper application of the principle of deferred prosecution in criminal proceedings, the problems that arise in its application, as well as the unification of the actions of public prosecution offices. The authors’ intention when drafting the manual was to standardize prosecutorial practice, while fulfilling the goal of the principle of deferred prosecution, i.e. achieving the purpose of punishment without conducting criminal proceedings when it is not necessary, or expedient from the aspect of public interest. The manual was prepared by a working group formed by the Republic Public Prosecutor's Office, with the support of the OSCE Mission to Serbia in 2019. This is its third edition, amended and supplemented in 2022 in accordance with new court decisions relevant to the application of the provisions of the CPC concerning the application of the principle of deferred prosecution in criminal proceedings, and the issue of the application of the principle to juvenile offenders was additionally addressed.
